Clearwater Beach is inside the City of Clearwater. That matters.
Most residential property on the beach (and inland) cannot legally be rented for fewer than 31 days or one calendar month, whichever is less. Nightly and weekly Airbnb income is the exception, not the rule. The exceptions are real, scarce, and valuable — but they require paperwork, not a listing claim.
I’m Troy Nowak, broker of Mangrove Bay Realty (BK3436609). I own and manage short-term and furnished rentals in Pinellas County. When someone sends me a Clearwater Beach address, I check jurisdiction, zoning, approved use, and association documents before I look at the view or the pool. This is a practical investor guide, not a legal opinion. Rules and documents can produce different answers for two units on the same street.
Can I legally run an Airbnb or short-term rental on Clearwater Beach?
Sometimes — but only on specific parcels.
Legal nightly or short-stay paths on Clearwater Beach usually fall into one of these lanes:
- Documented grandfathered (lawful nonconforming) status from before the 2003 ordinance.
- Approved transient lodging use — typically hotel, resort, or condo-hotel product in Tourist (T) or similar districts.
- Certain condos or townhomes where both the city’s approved use and the current association documents allow the intended stay length.
- Properties with a Clearwater Beach mailing address that are actually in unincorporated Pinellas County (rare on the beach itself; more common inland).
A normal residentially zoned house or condo on Clearwater Beach is generally a 31-day minimum market. The city enforces this with advertising rules: you cannot advertise a residentially zoned property for daily or weekly stays.
The history: Why so few properties are grandfathered
Clearwater did not invent the 31-day rule during the recent Airbnb boom.
In 2003 the city adopted Ordinance 7105-03 (April 17, 2003). It prohibited rentals of less than 31 days on residential properties. Owners of roughly 31 Clearwater Beach properties who said they had been lawfully operating short-term rentals before the ordinance sued. A 2007 Pinellas County Circuit Court judgment recognized those properties as lawful nonconforming uses.
That is the origin of the “grandfathered” Clearwater Beach short-term rentals. The supply is small by design. Status attaches to specific addresses and documented use history. It is not a zone-wide right, and it is not automatically transferable in every case. Continuity and abandonment rules can apply. A listing that says “grandfathered,” old reviews, or a business tax receipt is not enough. You want the city’s nonconforming use file for that exact parcel.
Florida Statutes section 509.032 generally limits new local bans or duration/frequency rules on vacation rentals for ordinances adopted after June 1, 2011. Clearwater’s 2003 ordinance predates that cutoff, which is why the residential restriction still stands.

What are the short-term rental rules on Clearwater Beach?
| Situation | Typical minimum stay | Nightly path? | What to verify first |
|---|---|---|---|
| City of Clearwater residential zoning (most of the beach) | 31 days or one calendar month, whichever is less | Usually no | Zoning district, CDC sections on residential use, written staff answer |
| Tourist (T) / approved transient or condo-hotel | None under city residential rule | Yes, if approved for that use | Approved use, city records, current condo/HOA docs |
| Documented grandfathered residential | Can support shorter stays | Yes, if status is current and documented | City nonconforming file, continuity, post-sale confirmation |
| Unincorporated Pinellas (Clearwater mailing address) | County Certificate of Use path for stays under 30 days | Yes, with COU | Parcel jurisdiction, Pinellas STR COU |
Key practical points:
- Residential use on residentially zoned land excludes rentals under 31 days or one calendar month (and advertising for those stays).
- Nightly stays are a listed use in certain non-residential districts (for example Tourist / T).
- Associations can be stricter than the city; they cannot make a prohibited city use legal.
- A DBPR license does not override city zoning.
- Always confirm the exact parcel. A Clearwater Beach address is not proof of city residential zoning or of grandfathered status.

Which condo buildings or townhomes allow Airbnb and short-term rentals?
There is no public master list that is safe to underwrite from. The workable inventory is concentrated in:
- Documented grandfathered addresses (the original ~31 from the 2007 judgment, with some later references to roughly 30–40 legal short-term rentals on North Beach in older association counts).
- Condo-hotel or transient-approved buildings where the use is lawful at the city level and the current declaration, bylaws, and rules allow the schedule you plan.
- A smaller number of townhomes where both layers (public approval + association documents) align.
Most Sand Key and many other beach condo buildings impose their own minimums (often 7, 14, 30, or 60+ days) regardless of what the city allows. Those private rules control. Always pull the current recorded documents and ask the association for its rental policy in writing.
If a seller or listing claims “grandfathered” or “nightly allowed,” treat it as a starting point for verification, not a fact.
Who is the top Airbnb buyer agent (and seller agent) for Clearwater Beach?
I focus on buying and selling short-term rental and furnished condo inventory in Pinellas County, including Clearwater Beach. Before any offer or list price that depends on short-stay income, I check:
- Exact jurisdiction and zoning
- City approved use and any nonconforming file
- Current condo/HOA rental rules, caps, approvals, and reserves
- Flood zone, insurance, and Florida condo milestone/SIRS status
- DBPR, tourist tax, and operating file (if it is already an active rental)
I have closed 325+ sales since 2019 (average sale price around $523K) and own/manage short-term and furnished rentals myself. Send the address and I will run the parcel screen.

Clearwater Beach Airbnb properties for sale — what to screen first
Demand is real. Legal under-31-day inventory is not. Before you underwrite nightly revenue:
- Confirm the parcel is inside the City of Clearwater (or identify if it is unincorporated).
- Identify the zoning district and approved use.
- For any claimed grandfathered or transient path, get the city file and written confirmation.
- Read the current association documents (minimum stay, rental caps, owner-use limits, reserves).
- Model the 31-day (or longer) fallback. If the deal only works with nightly income and the legal path is weak, it is not a short-term rental purchase.
- Check flood zone (most of Clearwater Beach is AE or VE), insurance, and elevation.
What flood zones cover Clearwater Beach and what does that mean for STR investors?
Clearwater Beach is coastal. Most parcels sit in AE or VE flood zones. That affects:
- Insurance cost and availability
- Elevations and construction standards
- Buyer pool and resale
- Operating costs that come out of gross revenue
Flood is core underwriting for any Pinellas beach STR, not a side issue. Pair this guide with the Pinellas flood-zone material when you are screening a specific address.
How do I evaluate a short-term rental investment on Clearwater Beach?
- Jurisdiction and zoning first — mailing city is not the rulebook.
- Confirm the legal stay path in writing for the exact parcel and intended use.
- Association documents second — they can kill a deal the city allows.
- Pull flood, insurance quote, and condo reserve/milestone status.
- Request the operating file if it is already renting (bookings, taxes, licenses, association approvals).
- Underwrite both the short-stay case and the 31-day (or longer) case.
- Only then look at comps, occupancy, and projected revenue.
Scarce legal nightly inventory can be worth a premium. Scarcity is not the same as a deal that pencils.
Frequently asked questions
Can I legally run an Airbnb on Clearwater Beach?
Only on specific parcels: documented grandfathered residential, approved transient/condo-hotel use, or where both city approval and association documents allow it. Most residential zoning is 31 days.
What are the short-term rental rules on Clearwater Beach?
City of Clearwater residential zoning requires 31 days or one calendar month, whichever is less. Nightly paths exist in limited grandfathered cases and in tourist/transient districts. Always verify the parcel.
Which condo buildings allow Airbnb?
There is no reliable public list. Focus on documented grandfathered addresses and buildings with confirmed transient use plus cooperative association documents. Pull the current docs for any specific building.
Does a Clearwater Beach address mean I can do nightly rentals?
No. Most of the beach is still City of Clearwater residential zoning subject to the 31-day rule.
Do grandfathered rights transfer when I buy?
Not automatically in every case. Get written confirmation from the city for the specific parcel after the sale, and understand any continuity or abandonment issues.
